Inventive step

Position b was rejected by the court because it was based on hindsight knowledge, a common error in patent law, particularly in questions regarding the inventive step and determining the closest prior art. As we just learned, the closest prior art must be chosen from  the knowledge available at the priority date, not when the patent is challenged.
